Terms of Service

1. Plain-English summary.

You use ENCORE. We deliver the product. You keep your content. We keep our software. Nobody surprises anybody.

If you violate the Acceptable Use rules — especially around Twin Mode — we shut your account down. If we break the product, we’ll refund you. The rest is the legal long-form. Email legal@encore.app with questions.

2. Your account.

• You must be at least 13 (or 16 in the EU/UK) to use ENCORE.
• One human per account. No shared accounts. No bots.
• You’re responsible for keeping your password secure. 2FA strongly recommended.
• You’re responsible for what happens on your account.

3. Acceptable use.

You may not use ENCORE to:

• Create content that violates someone’s rights — including impersonating real people without consent.
• Generate CSAM, non-consensual intimate imagery, or content that sexualizes minors. We report violations to authorities.
• Generate content designed to deceive in regulated contexts (elections, finance, medical, legal advice).
• Spam, harass, defraud, or run scams.
• Scrape, reverse-engineer, or attempt to extract model weights from our systems.
• Resell or sublicense ENCORE access without an Agency or Enterprise plan.

Violations result in immediate account suspension. Severe violations are reported to relevant authorities.

4. Twin Mode — special rules.

Twin Mode requires extra care. By enrolling a twin, you agree to all of the following:

• The twin must be of yourself. Liveness check enforces this. No exceptions.
• You consent to render content with your trained twin until you delete it. You may delete it at any time.
• You agree to the invisible watermark on every Twin output. It is part of EU AI Act and US deepfake disclosure compliance.
• You agree to the audit log being retained for 7 years.
• You will not use your twin to impersonate yourself for fraud — including phishing, voice-clone scams, or financial fraud.
• You will not attempt to remove or obscure the watermark.
• You will not bypass the liveness check to enroll someone else’s likeness.

Violating any Twin Mode rule results in immediate twin deletion, account suspension, and potential legal action depending on jurisdiction.

5. Your content.

• You own your content. Brand kit, footage, scripts, outputs — all yours.
• You grant ENCORE a limited license to process your content solely to deliver the product (render, schedule, analyze).
• We never use your content to train models for other users. This is non-negotiable.
• You’re responsible for ensuring you have the right to use any footage you upload — including third-party music, stock footage, and likenesses of others.

6. Billing & refunds.

• Free tier: always free. No credit card required.
• Pro / Studio: 14-day free trial. Cancel anytime. Monthly plans cancel in 2 taps.
• Annual plans: refundable within 30 days of purchase. After 30 days, pro-rated credit for the remaining months (not cash refund).
• Agency: annual contract. 30-day paid pilot available before annual commitment.
• The ENCORE Guarantee: if ENCORE doesn’t save you at least 5 hours in your first 30 days, we’ll refund your first month. Email billing@encore.app. No questions.
• Taxes: exclusive of applicable taxes (VAT, sales tax, GST). Added at checkout where required.

7. Intellectual property.

• Our software is ours. The ENCORE name, logo, mark, brand system, recommendation engine, vendor router, and proprietary models are property of ENCORE Inc.
• Your output is yours. Subject to any underlying third-party rights (music, stock, etc.) — see Section 5.
• Feedback you give us is ours to use — but you’re not obligated to give feedback.

8. Disclaimers & liability.

ENCORE is provided “as is.” We don’t guarantee specific output quality, uptime, or business outcomes (although we work very hard at all three).

Our liability is capped at the amount you’ve paid us in the prior 12 months. We’re not liable for indirect, consequential, or punitive damages.

None of this limits liability that cannot be limited under applicable law.

9. Termination.

• You can terminate at any time by deleting your account in-app or emailing hello@encore.app. Full deletion within 7 days.
• We can terminate for material violation of these terms — usually with notice. For serious abuse (especially Twin Mode violations), we may terminate immediately.
• On termination, your data is deleted per our Privacy Policy. Pre-paid annual fees are refunded pro-rata unless terminated for cause.

10. Changes to these terms.

We may update these terms. Material changes get 30 days’ notice via email. Continuing to use ENCORE after the effective date constitutes acceptance.
